1. Definitions
In these Terms and Conditions, the following terms have the meanings set out below:
- "Agreement" means the engagement letter or written scope agreement entered into between Dul Legal and a Client for the provision of Services.
- "Client" / "You" means any individual who engages or enquires about Dul Legal's Services.
- "Services" means the legal advisory and representation services relating to pension matters offered by Dul Legal as described on our website and in written scope agreements.
- "We" / "Us" / "Our" means Dul Legal, operating from 74/3 Rama IV Road, Khlong Toei, Bangkok 10110, Thailand.
- "Website" means the website operated at dullegalad.pro.
- "Content" means text, documents, information, and materials published on the Website.
2. Acceptance of Terms
By using our Website or engaging our Services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, you should not use the Website or engage our Services.
Our Services are available to individuals aged 18 and over who have the legal capacity to enter binding agreements under Thai law. We reserve the right to decline to enter into an engagement with any person.
3. Service Description
Dul Legal provides legal advisory and representation services in relation to pension matters in Thailand. Our current service offerings are:
- Initial Pension Consultation (฿1,800 per session)
- Claim Preparation and Representation (฿5,800 per matter)
- Comprehensive Pension Matter Support (฿9,700 per matter)
Services are available to clients in Thailand and, for remote consultations, internationally. Service scope, deliverables, and fees are confirmed in a written scope agreement before commencement.
4. Client Responsibilities
To enable us to provide Services effectively, you agree to:
- Provide accurate, complete, and up-to-date information when requested
- Inform us promptly of any changes to your situation that may be relevant to the matter
- Respond to requests for documents or information within a reasonable time
- Use the Website and our communications in a lawful and respectful manner
- Not provide false, misleading, or fraudulent information in connection with our Services
5. Intellectual Property
All Content on the Website, including text, design, and structure, is the intellectual property of Dul Legal or its licensors and is protected under applicable Thai and international law.
Documents prepared by Dul Legal in the course of delivering Services are provided for use in connection with your matter only. They may not be reproduced, published, or distributed without our prior written consent.
6. Payment Terms
Fees are as stated in our written scope agreement. Payment is due in Thai Baht (฿). We accept bank transfer and other payment methods agreed at the time of engagement.
For the Initial Pension Consultation, payment is due prior to or at the time of the session. For other services, payment terms are set out in the scope agreement.
Cancellation and Refunds
Consultation sessions cancelled with less than 24 hours' notice may be subject to a cancellation fee. For other services, refunds are assessed on the basis of work completed at the time of cancellation. Any refund amount will be discussed and agreed in writing.
7. Service Delivery Terms
The scope of each service is confirmed in writing before commencement. Changes to agreed scope are discussed with the client before any additional work begins and will not result in additional charges without your prior agreement.
Timelines for claim preparation and representation depend in part on the responsiveness of third parties and authorities. We will keep you informed of progress and of any factors outside our control that affect timing.
Comprehensive Support services continue until the matter reaches a natural conclusion or is terminated by either party in accordance with these terms.
8. Disclaimers
Content on the Website is provided for general information purposes and does not constitute legal advice. Engaging our Services through a written scope agreement establishes the advisory relationship.
The outcome of any legal matter depends on factors including third-party decisions, authority processes, and the specific facts of a situation. We cannot and do not promise any particular result. Our commitment is to carry out the work to a professional standard.
The Website is provided in good faith but we make no warranties regarding its accuracy, completeness, or availability at all times.
9. Limitation of Liability
To the extent permitted by Thai law, our liability in connection with any Service shall not exceed the fees paid by you for that Service.
We are not liable for indirect, consequential, or incidental loss arising from use of the Website or engagement of our Services, except in cases of fraud or gross negligence.
We are not responsible for delays or failures caused by circumstances outside our reasonable control, including authority processing times, postal delays, or force majeure events.
10. Confidentiality
We treat all information shared in the course of a matter as confidential. We will not disclose your information to third parties except where necessary to deliver the Services, where required by law, or with your express consent. Our obligations under this clause survive termination of any engagement.
11. Termination
Either party may terminate an engagement by providing written notice. In such cases, you will be liable for fees corresponding to work completed up to the date of termination.
We reserve the right to decline or discontinue a service engagement where we are unable to continue acting in a matter for professional reasons. Where this occurs, we will provide reasonable notice and any applicable refund of fees for uncompleted work.
12. Dispute Resolution and Governing Law
These Terms and any dispute arising from them are governed by the laws of Thailand.
In the event of a dispute, we encourage you to contact us at [email protected] so that we can seek an informal resolution before any formal proceedings.
Any formal dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Thailand.
13. General Provisions
- Entire agreement: These Terms, together with any written scope agreement, constitute the entire agreement between the parties regarding the Services.
- Severability: If any provision is found to be unenforceable, the remaining provisions remain in full effect.
- Waiver: Failure to enforce any provision at any time does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under any engagement without our prior written consent.
- Notices: Formal notices should be sent to our office address or to [email protected].
14. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on the Website with a revised Last Updated date. Continued use of the Website or our Services after such changes constitutes acceptance of the revised Terms. Existing scope agreements are not affected by changes to these Terms unless both parties agree in writing.
